The Constitution in Jeopardy with Russ Feingold

Join the European Law Institute Fundamental Rights Law Special Interest Group and the American Constitution Society for a discussion with former United States Senator and ACS President Russ Feingold, who will discuss the state of American democracy and his book, The Constitution in Jeopardy: An Unprecedented Effort to Rewrite Our Fundamental Law and What We Can Do About It.

Over the last two decades, a fringe plan to call a convention under the United States Constitution’s amendment mechanism—the nation’s first ever—has inched through statehouses. In his book, Feingold examines this quiet effort to radically change the United States Constitution. If realized, the plan would allow convention delegates nearly unlimited authority to draft alterations to anything from voting and free speech rights to regulatory and foreign policy powers. He distills extensive legal and historical research and examines the grave risks inherent in this effort, while considering the role of constitutional amendment in modern life and offering a way forward.

A Brief Overview of 42 U.S.C. § 1983

Want to learn about the most important part of Constitutional Law that isn't taught in Constitutional Law? Join ACS for a brief overview and discussion surrounding 42 U.S.C. § 1983. This provision of the US Code gives an individual the right to sue certain government employees and others acting "under the color of state law" for violations to their constitutional rights. If you're interested in learning how civil rights violations are litigated and how damages and injunctive relief are sought to remedy those violations, this event is just for you! The discussion will be led by Professor Gerald Weber, former legal director of the ACLU of Georgia, principal in The Weber Law Offices, and current senior staff counsel at the Southern Center for Human Rights. Lunch will be served.

Visit to the Third Circuit Court of Appeals and Conversation with Judge L. Felipe Restrepo

Judge L. Felipe Restrepo of the U.S. Court of Appeals for the Third Circuit has kindly invited ACS members to come to a Third Circuit argument and then visit his chambers afterwards.. He is sitting for arguments on Wednesday, November 8th from 1:00pm - 4pm and Thursday, November 9th from 8:30am - 11am. There will be around 90 minutes of argument, followed by a closed-door panel caucus that will take around 30 minutes, and finally a visit to the Judge’s chambers afterward. On both days, everyone will need to arrive on time and be willing to stay for the entire session. On Wednesday, the judge will be hearing a Sixth Amendment right to effective counsel claim, a qualified immunity claim, and a bankruptcy case about FTX. On Thursday, the judge will be hearing a case on an Eighth Amendment claim regarding prison abuse and an appeal regarding a habeas corpus petition.
