“The events surrounding Comey's firing raise questions for investigators in Congress and the Department of Justice. The most immediate questions are why, why now and whether the administration will appoint a truly independent investigator. The dismissal politicized the Bureau and jeopardizes the rule of law. What will stop the president from demanding loyalty from the next FBI director over a piece of chocolate cake? The most important obligations of the FBI director are to the American people and the Constitution.”

“As the 84th attorney general, Sen. Jeff Sessions reports to a president notoriously disrespectful of the administration of justice. In a matter of days, President Trump has threatened the independence of the U.S. Department of Justice by rashly firing Acting Attorney General Sally Yates. Subsequently, by bullying Judge James Robart and the Ninth Circuit Court Trump has shown a stunning disregard for our system of checks and balances. As head of the Department of Justice, Sessions serves the American people and takes an oath to uphold the Constitution, not shield the White House. The big question is: will he?”

Washington, D.C. – American Constitution Society President Caroline Fredrickson made the following statement on President Trump’s attack on a federal judge who temporarily blocked his Executive Order on immigration:

“President Trump’s attack on a federal judge is inexcusable. Sadly, we have seen a pattern of total disregard for the Constitution and the rule of law in the president’s behavior. While on the campaign trail, then-candidate Trump blasted a federal judge for his ethnic heritage, saying he was incapable of ruling fairly because he was Mexican-American. Now, he has attacked another federal judge for refusing to bow to political pressure, this after firing the acting Attorney General for the same thing when she refused to defend his discriminatory Muslim ban. We have separation of powers in this country, guaranteed by the Constitution. It is clear President Trump thinks he is above the law. This puts us in very dangerous territory.”

Washington, D.C. –  Former Senator Tom Coburn (R-Okla.) today called for the U.S. Senate to hold a vote, at least in the Senate Judiciary Committee, on Supreme Court nominee Merrick Garland.

“Sen. Coburn may be one of only a very few Republicans who think the Senate should do its job, but his new call for a vote on Chief Judge Merrick Garland is in line with the American people. The Constitution is clear. The president has fulfilled his duty by nominating Judge Garland. It is up to the Senate to fulfill its duty and give him a fair hearing and an up-or-down vote. We call on the Republican leaders in the Senate to follow Sen. Coburn's lead.”
