U.S. Senate Should Stand Up for Rule of Law, Democracy with Judicial Nomination Votes

Washington, DC – The American Constitution Society released the following statement in response to the Trump administration's first judicial nominations of this term: 

"At this moment in history, where President Trump is dismantling American institutions and throwing the nation into constitutional chaos, it’s critical to remember that the courts are an independent and coequal branch of government. Judges from across the ideological spectrum have demonstrated this by withstanding the administration’s assault on the legal profession and the rule of law, slowing or stopping some of the worst of the President’s unconstitutional actions.  

With the announcement of the nominations of Whitney Hermandorfer to the Sixth Circuit and four individuals to federal district courts in Missouri, senators will have the opportunity to join the courts in doing their part to stand up for law and democracy. In deciding whether or not to confirm, senators from both parties must ask if these nominees have demonstrated the legal acumen, temperament, and independence to uphold the constitutional role of the courts as independent arbiters of the law. ACS is working to ensure the courts remain independent and continue to reflect the diversity of the American people.”
