Originalism is Impossible: Articulating a Progressive Constitutional Vision

Join Penn Law ACS on Wednesday, March 23 at noon on Zoom for a panel discussion exploring the contradictions of originalism featuring Professors David Strauss of the University of Chicago Law School, Eric Segall of Georgia State College of Law, Jonathan Gienapp of Stanford University, and moderated by our very own Professor Mitchell Berman. 

This panel of leading critics of originalism will discuss holes in the theory from its detachment with the actual history of the Constitution to its incompatibility with critical cases such as Brown v. Board, as well as what a progressive alternative to originalism should look like.
