In Search of a Progressive Theory of the Constitution to Challenge an Activist Right-Wing Supreme Court

As a right-wing Supreme Court moves farther away from the American mainstream, progressives have offered little more than condemnation. In this talk, Professor Sanders will argue that liberals need to look beyond the "living Constitution" and become more effective at articulating substantive constitutional values that most Americans share. The Constitution is a political document, and progressives must more effectively engage with the political contest over its meaning.
