Health Data Protections in the Age of Social Media

Moritz College of Law, Columbus, Ohio

Can Apple or Fitbit sell your step counts? Does Facebook only sell your personal information to groups like Cambridge Analytica to tailor political ads? Or, can Facebook or Twitter sell your personal information to groups collecting anonymous health data? Is it legal for Facebook to instead take your information and use it to re-identify anonymous health data to then sell to other groups? Please join the American Constitution Society and the Intellectual Property Law Society for a discussion on data protections under the Constitution and applicable federal laws. Our discussion will focus on what happens to your health data with entities not covered by HIPAA and the growing demand for organizations to re-identify and sell health data protected by HIPAA.
