ACS Georgia: Constitutional Conversations: The Right to a Fair Trial in Criminal Cases

Join the ACS Georgia Lawyer Chapter for the next installment in its Constitutional Conversations series, a set of discussions on current issues in constitutional law hosted with the Fulton County Libraries.

This conversation will be about the right to a fair trial in criminal cases.. The right to a fair trial is enshrined in the Sixth Amendment to the U.S. Constitution and in the comparable provisions of the Georgia constitution. To ensure a fair trial, it is the function, if not the duty, of the trial judge and trial counsel to make the adversarial testing process work in every particular case. This presentation will cover the roles of the three participants: the trial judge, the prosecutor and the defense counsel. It will discuss impropriety by the trial judge, including recusals, the ever-expanding role of the prosecutor, ineffective assistance of defense counsel, and the right to represent oneself.
