A Discussion on Racism and Mass Incarceration in Supreme Court Doctrine
Join ACS as we welcome Professor Maria Hawilo from Loyola University Chicago for a seminar-style discussion on the history of mass incarceration, its roots in institutional racism, and the ways in which race has been stripped out of our constitutional doctrine. Professor Hawilo’s work centers on the criminal legal system’s vast overreach and disparate impact on racial minorities. Using Terry v. Ohio as a case study, we will consider what facts courts find important to include in judicial opinions and how that colors our understanding of doctrinal development.
