Washington, D.C.  – American Constitution Society President Russ Feingold released the following statement in response to the Biden-Harris administration’s Executive Order creating the Presidential Commission on the Supreme Court.

“We need to have a substantive conversation about court reform in this country. Our judiciary is facing a legitimacy crisis between the theft of two Supreme Court seats and the packing of the courts with right-wing ideologues by the previous administration.

The Presidential Commission on the Supreme Court could be an opportunity to advance this conversation. I’m heartened to see so many friends of ACS on the Commission who care deeply about the credibility of our judiciary.

This cannot be an academic exercise however. For the sake of our democratic legitimacy, this Commission needs to operate with urgency and to prioritize specific and meaningful recommendations.”
