The Supreme Court's "Shadow Docket"

This discussion will examine the Court’s increasing reliance on non-merits decisions (commonly referred to as the shadow docket) and the implications of this practice for fundamental rights such as due process, as well as for important remedies like universal injunctions. We will be providing lunch for attendees. Professor James Pfander will be speaking. We are also considering adding a second speaker.
