ACS Docket Discussion: Independent State Legislature "Theory" and Partisan Gerrymandering
Join UNC Law Professor Ted Shaw and Duke Sanford School of Public Policy Professor Asher Hildebrand for a discussion in advance of the Supreme Court's oral arguments in Moore v. Harper. This case, involving the independent state legislature doctrine, considers whether state legislatures alone are empowered by the Constitution to regulate federal elections, without oversight from state courts. The panelists will discuss how the case may fundamentally change federal elections, and if adopted, how the independent state legislature doctrine would be a major setback for free and fair elections and democracy.
