No License to Harm: Conversion Therapy and LGBTQ+ Health Law after Chiles

Indiana Maurer School of Law, Room 123, Bloomington, IN

In Chiles v. Salazar (2026), the Supreme Court held 8–1 that Colorado’s conversion therapy ban constitutes viewpoint discrimination subject to strict scrutiny.

Join Maurer’s LGBTQ+ Project, OUTLaw, and ACS for a conversation with Prof. Heather McCabe (Saint Louis University) and Prof. Yvette Butler (IU Maurer School of Law) to explore the regulatory space Chiles preserves and practical paths forward—including how legislatures can draft toward the Kagan concurrence, and how Chiles’s own logic may subject to strict scrutiny state laws that endorse gender-denying care while condemning gender-affirming care.
