In Citizens United v. Federal Elections Commission, a 5-4 decision handed down just over two years ago, the Supreme Court struck down restrictions on independent spending in federal elections. While the implications of this decision have been closely examined in the context of the upcoming presidential election, its impact on judicial elections has been largely ignored. Almost forty states directly elect or hold retention elections for judges. What does Citizens United mean for these races? Is judicial independence at risk when parties to lawsuits and their lawyers can spend millions to help elect a judge?
