ACS is pleased to distribute an issue brief by Jocelyn Friedrichs Benson, Assistant Professor of Law at Wayne State University Law School, entitled “Towards Full Participation: Solutions for Improvements to the Federal Language Assistance Laws.” In this issue brief, Professor Benson examines the federally mandated language accommodations in sections 203 and 4(f)4 of the Voting Rights Act, arguing that these accommodations, while important and beneficial, are incomplete. Professor Benson highlights the deficiencies in existing voting protections for citizens with limited English proficiency levels, demonstrating how the protections fail to respond to the changing needs of an increasingly diverse electorate. Finally, Benson presents a number of remedies to these existing inadequacies, including: empowering the Election Assistance Commission or Department of Justice to strengthen coverage of potential language minority communities, improving the accuracy of ballot translations by federally certified translators, and ensuring enforcement of court orders where violations of the Voting Rights Act have occurred.
