ACS Chicago Lawyer Chapter Hosts "Making the Best of a Massey Situation: Disqualification, Due Process and the Supreme Court"
On July 31, 2009, the Chicago Lawyer Chapter held a discussion entitled "Making the Best of a Massey Situation: Judicial Disqualification, Due Process and the Supreme Court." The discussion was co-led by Charles Gardner Geyh, Associate Dean for Research and John F. Kimberling Professor of Law, Indiana University Maurer School of Law, Bloomington; and, via video conferencing, Andrew L. Frey, Partner, Mayer Brown, LLP, who argued Caperton v. A.T. Massey Coal Co. before the U.S. Supreme Court. Massey centered upon the issue of judicial recusal, where a litigant had given the trial judge a $1,000 campaign contribution and spent $3 million in personal funds on the judge's behalf. The discussion traced the history of judicial recusal from English common law in the 1700's to the current ABA Model Code of Judicial Conduct.
