ACS Milwaukee Lawyer Chapter hosted "The Constitution in 2020: Why the Constitution Matters"

On July 21, 2010, the Milwaukee Lawyer Chapter hosted Mark Tushnet, the William Nelson Cromwell Professor of Law, Harvard Law School, Contributing Author, The Constitution in 2020; and Author, Why the Constitution Matters, for a program entitled, “The Constitution in 2020: Why the Constitution Matters,” where Professor Tushnet discussed his views on constitutional interpretation by the U.S. Supreme Court. Professor Tushnet was introduced by Professor Dean Joseph Kearney of Marquette University Law School. Court of Appeals Judge Joan F. Kessler and State Representative Fred Kessler were in attendance.

ACS Milwaukee Lawyer Chapter hosts "President Obama and the Federal Judiciary: A View from Capitol Hill"

Michael Zubrensky, senior counsel to Assistant Senate Majority Leader Dick Durbin (D-IL) addressed the Milwaukee Lawyer Chapter of ACS on November 12, 2009, to discuss President Obama’s impact on the federal judiciary.

Milwaukee Lawyer Chapter Presents "Judicial Selection Forum"

On January 29, 2009, the Milwaukee Lawyer Chapters of the American Constitution Society and the Federalist Society co-sponsored a presentation on “The Methods of Judicial Selection” at the University Club in downtown Milwaukee. The presenters were Judge James Wynn of the North Carolina Court of Appeals and Associate Justice Harold See Jr. of the Alabama Supreme Court. The topic was timely since Wisconsin has for two consecutive years seen highly politicized elections for seats on the state Supreme Court. The event was attended by a crowd of 60.

The speakers agreed on a number of issues. Elections have become costly, attracting third-party ads, and have been marked by a degree of ugliness. But nearly 80% of the states use the election process, and Tennessee is poised to join that number. No state has switched to merit selection in at least 15 years. In Judge Wynn’s view, elections should be used but should be improved by public financing, as in North Carolina, and by greater public education.

Milwaukee Lawyer Chapter Presents "Restorative Justice: A Way to Bring Healing to Victims and Communities"

On December 3, 2008, at the Milwaukee Bar Association, the Milwaukee Lawyer Chapter hosted a presentation on Restorative Justice by retired Wisconsin Supreme Court Justice Janine Geske. The Justice has a unique perspective on the topic: she has served as a trial and appellate judge and now is a Distinguished Professor of Law at Marquette University Law School where she teaches and implements the practice. The event was attended by 17 engaged participants.

Justice Geske described the unique approach taken by restorative justice. Rather than focus on the defendant, as the traditional justice system does, it focuses on the victim by examining the harm caused by the offenders while requiring them to take responsibility for their actions. Some interesting aspects of restorative justice described by Justice Geske included:

  • arranging participants in a circle and passing a talking piece to limit who speaks at any given time;
  • allowing victims, and the family of victims, to ask questions of the offender (in a homicide context they often want to know what the last thing said by their loved one was);

Milwaukee Lawyer Chapter Presents "Potential Voting Rights Issues in the 2008 Election"

The ACS Milwaukee Lawyer chapter presented a compelling and timely panel on Voting Rights Issues on October 6, 2008. Panelists included Professor Daniel Tokaji from the Michael E. Moritz College of Law at Ohio State University; Jenigh Garrett, counsel with the NAACP Legal Defense Fund; and Kathy Nickolaus, Waukesha (WI) County Clerk. The panel moderator was Louise Petering, President of the League of Women Voters of Milwaukee County.

The discussion ranged from issues of national importance – including improper purges of eligible voters from registration lists – to issues peculiar to Wisconsin – like the recent lawsuit of the State Attorney General (and McCain State Co-Chair) to require matching of newly-registered voters back to 2006. Panelists agreed that Wisconsin’s same-day registration law would eliminate issues like requiring provisional ballots since voters could overcome objections by simply re-registering at the polls. They also pointed to the practice of allowing voters to cast a ballot at a previous residence if they had an intent to return there in the future.

On April 5th, the Milwaukee Lawyer Chapter of the American Constitution Society hosted a spectacular event, marking the chapter's successful first year. The well attended event featured former Congressman and current Milwaukee Mayor Tom Barrett and keynote speaker Senator Russ Feingold (D-WI). Lisa Brown and Milwaukee Chapter Leader Gwendolyn G. Connolly also made remarks. Senator Feingold's speech focused on several recent controversies which have been recently probed by Congress, including the firing of eight U.S. Attorneys, the Inspector General's report finding that the FBI illegally issued National Security Letters, and the Administration's warantless wiretapping program. Members joined together for a reception following the event.
