As the White House gears up for the confirmation hearings for President Obama's first Supreme Court nominee, it has become clear that the topic of marriage equality (a.k.a., same-sex marriage) will be front and center. Cornell Law professor William Jacobson even suggested in a lengthy article in Sunday's edition of The Washington Post that same-sex marriage could outperform abortion as the "flash point" of this summer's main event.
In light of the weekly and even daily developments across the country on marriage equality in the few short months since the President took office, it's easy to see how such a topic could dominate discussion. It's not the past developments, though, that are prompting the focus.
Most recent developments, in fact, appear to defuse conservatives' cries about "activist courts." Save for the Iowa Supreme Court's decision in April, in which the court vigorously defended against claims of judicial activism, most of the current state court battles -- from California to Wisconsin -- are procedural challenges -- not broad, equal protection or due process challenges. What’s more, most of the marriage developments -- from Vermont to Maine to D.C. to New Hampshire -- have come from lawmakers -- not courts. Further still, there has been a concerted effort and great success at chipping away at religious objections by recognizing broad religious exemptions in civil marriage laws in Connecticut and Maine and -- soon -- New Hampshire.
So, with all of that, why is there such a focus on the thoughts of one potential U.S. Supreme Court justice on marriage equality?
The answer, despite the failure of The Washington Post to mention it in its Sunday article, is simple: Gill, et al. v. Office of Personnel Management, et al.
The case, brought in the U.S. District Court for the District of Massachusetts on March 3 by the Gay & Lesbian Advocates & Defenders (GLAD), requests that the Court "[d]eclare DOMA, 1 U.S.C. § 7, unconstitutional as applied to the plaintiffs."
The Defense of Marriage Act (DOMA) was passed by Congress in 1996 and signed into law by President Bill Clinton. The law contains two main provisions, only one of which is challenged in Gill. It challenges the part of the law that defines "marriage" and "spouse" in all federal law -- including "any ruling, regulation, or interpretation" of an agency or department -- as always and only referring to marriages between one man and one woman. The unchallenged portion abrogates the Full Faith and Credit Clause and allows states to refuse to recognize same-sex marriages performed in other states.
The federal definition is particularly problematic as more and more states begin to allow same-sex couples to marry. Just one simple example: A couple's taxes, filed jointly at the state level, cannot be filed jointly with the IRS. The Gill lawsuit puts it as thus:
Because DOMA, 1 U.S.C. § 7, as applied by the IRS, requires this disparity of treatment with regard to the federal income tax filing of [a same-sex couple married legally in Massachusetts], it creates a classification that treats similarly-situated individuals differently without justification in excess of Congressional authority in violation of the right of equal protection secured by the Fifth Amendment of the Constitution of the United States
This -- this case, this paragraph -- is the filed, pending-in-court issue that has Sens. Hatch and Sessions and other social conservatives at the ready. This is a case that could take off from Justice O'Connor's equal protection opinion in Lawrence v. Texas and render federal marriage discrimination unconstitutional. All of those thousand-plus federal benefits of marriage identified by the Government Accountability Office would then be available to those gay and lesbian couples who chose to marry in states where they can do so.
This case, though, truly is not all that expansive of a marriage equality case. The Full Faith and Credit Clause abrogation would remain in effect. Even a successful result, therefore, would not be the type of case that the counsel for the anti-marriage equality Alliance Defense Fund, in describing his fears of an activist court, called "a Roe v. Wade trump card."
This case instead focuses on the uniqueness of the federal definition of marriage found in DOMA, because -- prior to DOMA -- "the United States has consistently deferred to the sovereignty of the States when the marital status of an individual has been used" to determine federal benefits. Apply that history to the resulting disparity between legally married straight couples and gay couples, and it's not too hard to imagine a court ruling of the type sought by GLAD.
Make no mistake, though, this case (not to mention the prospect of others like it) is front and center in any marriage discussion of Obama's nominee. In a few years, this case could be heard by the Supreme Court and -- if Congress has not yet acted to remove this anomaly from federal law -- President Obama's nominee could be pivotal in framing an equality argument that wins over a majority of the justices on the high court.
As such, it should not only be social conservatives who try to glean what they can from a potential nominee's answers. All those who support fairness and equality should be watching to see whether President Obama's eventual nominee would see the inequality at the heart of DOMA's federal marriage definition.

Gay Marriage
But that's just my opinion. I myself am bisexual, and I have plenty of lesbian friends in happy relationships. I don't understand why gay marriage is considered to be so "bad". If two people are happy and in love, so be it! It's not affecting anyone personally except the two people involved in the relationship. Let them be happy. Banning gay marriage is the same as if we were to ban interracial marriage. Why should we stop people from being happy? When did it become our job to discriminate against people for being who they are? Straight people wouldn't like it if they were banned from being married, so why ban gay marriage?
Gays in general
I'm 17, I'm bisexual, and i don't understand why people can't treat people who have different sexualities the same as they treat straight people. Just because a man likes a man or a woman loves a woman doesn't mean they shouldn't be allowed to get married is certain areas. I myself love this girl, people treated me completely different after i told them, they didn't treat me with the respect they did when they thought i was staright. I just want people to understand there is nothing different about us, we are all people right? well why can't you treat us like it?
Making a difference.
People have their insignificance to realize that we are born the way we are today. Its not a disease to be homosexual at all! It simply is just the way people feel, think, and are. It is being! I challenge our state and every other state to just open your eyes, we have so many people here on this continent that are gay, that wish to be happy just as you are. But everyday, we are turned away, brushed off, or judged for who we are. I am almost 16, a freshman in high school, and I am a lesbian.
I walk around my school day by day, walking my girlfriend to class, getting glares from some, and thinking of how people can just judge somebody for who they truly are. I was terrified to come out of the closet, because I've seen what happens to most homosexuals, the way they are harassed, abused, rejected, and bullied. I simply did not want to be shunned for something I cant help but feel. But facing my fears I came out, and I am the same person I was before I came out, though I am happier that I can be who I truly am without hiding it.
People go to church, and they read the Bible everyday. They read the scriptures that tell how all gays have a place in Hell, and how being homosexual is not acceptable. Though they do not realize that the scripture also states that thou shalt not judge, and thou shall love thy neighbor. God has a purpose for all beings in this world, weather my purpose to be to test the Christian faith, or to help make a difference in the world. I do not know the reason I have urged myself to come this far, but I feel the need to protect my sexuality, as well as others.
I understand that all people have their own opinions, and I may not have the right words or phrases to change them. I understand the circumstances of my words, and of the worlds actions. I do not understand though, the way the constitution states that we have freedom of speech, when truly we do not have true freedom of speech. Also, the way the constitution states we have freedom of religion, but seeing as how we are constant judged for the love of Christianity, Buddhism, Satanic ways, Catholicism, we are not truly free.
I may only be a teenager, but I am a teenager who wants to grow up, get a good education, graduate college, get a job, have enough money for living expenses, build my life, get married to a wonderful wife, and start a family, no matter the cost of adoption or Artificial Insemination. I want to be happy too. But, by the looks of it, I may never be able to get married, to a lovely woman, to show her that I am truly hers. I will possibly be rejected of my feelings of equal marriage, my feelings of true love, and of my life as I know it. I do not know how to comprehend how people can take away the happiness of myself as well as others. I do not underestimate congress, or the president in anyways. I just simply wish to be happy for a change, and to have one thing in my life perfect for once. But because of my state not being able to marry the same sex, I will never know the life I want.

Why is it so bad?
I am 16 and proud to be gay. I believe that if you are lucky enough to find someone that loves you and you love them then what does it matter if they are the same sex? If it was a "regular" couple then their would be no controversy over the marriage at all. So people need to put their big girl panties on and get over it. We are no different than any other person we all put our pants on the same way.

Marital Rights
I really don't get it. To be denied the "right" of happiness. Does that give me the "right" to deny to pay taxes? We're allowed to join the Navy, Army, Airforce, Military, ect. We fight for your freedom but yet you still deny us ours. Approving gay marriage would definitely change a lot of things. One of them being, giving more loving homes to a child that has been abandoned by their straight parents, also decrease abortions. If you really don't like gay marriage, then stop having gay babies. To all those that denied us the right to get married, how do you feel knowing that you're not just denying it to a complete stranger but you're also denying one of your family members the joy that you feel. Each family has one gay family member, whether it being a mom, dad, son, daughter, cousin, uncle, aunt. How could you do that to someone. You might not have a gay child, but what if you end up having a gay grandchild? I'm happy I have a supportive family. They are there for me no matter what wrong or right I do. i have gay parents
my father has been with the same man since before i can remember. he's loving to all of us kids, and loves my father very much. they are not married due to the trouble surrounding the issue, but i would like to let every one know, you are born that way. i am straight, have been my whole life. i am not "corrupted" by my gay parents, they are just as loving and caring as any parents, and keep me on the right track. gay people are not "wrong" they are just people. let them have all the rights as everyone else. one day people will realize how dumb they were for trying to deny someone their rights, just as people did for the african american movement. everyone's equal. Gay Marriage
I am 19 years old and i have been with my girlfriend for two years. I don't know what i would do without her. I don't understand why it is so wrong for gays to be married. I could never be as happy as i am with my girlfriend and it kills me that we may never be able to get married. We would have to move to another state and have to be away from our families just to do so. That isn't right. In my state we have civil unions in which just got passed but its not the same! I will never be able to give the love of my life a wedding that she wants. It makes my blood boil when people talk about the United States being a free country. Love comes in many different disguises...
I'm not gay by any means but I am a firm believer in love. I'm 18 (woman) and I go to High School in one of the most rule areas in the state; sometimes it's a little bit shocking about what people have to say about gays and I do admit I take offense too it. Nobody should have to feel bad for being different or having different interests.
What comes to mind when people mention "The Same Sex Marriage" I think who are we to tell others whom they can and cannot love. This is the United States of American... I mean people come here from all over to be free and to live the life they want, (sarcasm) "but let's deny people who have been born and raised in the U.S the option of loving whomever they deem worthy."
Funny story about me is that I've had a few gay guy best-friends and I get a kick out of being with them because I love shopping and of course you have to invite them. So this onetime I stumbled across these cute pair of jeans and I would be like " Do these make my butt look big" sure enough you can always count of them for a honest answer. LOVE YOU FOR THAT! :)

Why the world hate true love!!!
I'm a 36 yr old woman who's been with my girlfriend for 6yrs. We want to get married next year. But it seems like we are running into hardship because of the laws of the land. I understand that we are loved by few and hate by many. Even so I feel that we should be able to marry and be happy. Like others say you can't help who you fall in love with. I prayed that god would send me someone to love me unconditionally. Long and behold he blessed me with the love of my life. She's been the best thing that's been in my life since slice bread. I love her with all my heart and soon the whole world will know that gays love is real and everlasting. The divorce rate now is higher then ever. You don't see that int he gay community because we don't judge we get overwhelm when we know of a gay couple been together longer then most straight marriage. I don't feel that it is okay that we get discriminated against and that people feel the need to do what ever they want to stop gay marriage and gay couples. I really would like people to stop the discrimination and just be happy that everyone is different. I really would wish that they wouldn't use the excuse that God made man and women. You need to tell them. Don't worry about what other people think. Parent wise, they might be shocked or a little angry at first, but they love you. And should accept you for who you are. There is absolulety nothing wrong with being gay. Don't be ashamed of it, be proud of who you are. Ignore the haters, and stay strong. I'm not saying it won't be hard, it's going to be. But you have to be strong enough to push yourself, and get through it. It will all be worth it in the end, I promise.

Same-Sex Marriage
I am not gay but a don't have a problem with people who are. Our Founding Fathers wrote in the Constitution that as are first amendment right we had the freedom of religion. Well where is that? The biggest argument people have against same sex marriage is that it is against God. Well isn't that going against the Constitution that this country is so firmly built off of? The Constitution talks about the belief of equality for all, so how could our country say it believes in something and not be doing it? Lets say that you are opposing same sex marriage and lets also say that the WHOLE world is gay and you are the only one who is not. What if the bible said that it was wrong to be straight? Would you think it was too? And if you just said yes then you are lying because it was the way you were born and you can't change that. There are people that say homosexuals can change but saying something like that is like saying people can change there skin. And do you think that the people that do change because they have so many mental and maybe even physical scars are really happy? It may seem like I am asking a lot of questions and I am but there is just so much to think about. Like what if someone told you that you could not marry the person you love? How would you feel? Well imagine what these people are dealing with every day? Do you remember that dark time when Hitler was killing all of those innocent people in concentration camps, and the US with the help of other country stood up and stopped him? But we did almost the same thing with the Japaneses and locked them up just because of their race. Oh and we cannot forget Marten Luther King and what he stood for and all the blacks that died. Well I guess what I am trying to say is that we haven't really changed. Millions of innocent people died because of stupid theories that other people have and they still are. People are dieing just because of there sexuality. Notes how I keep saying, “People,” because that's what they are just like you and me. And if you looked at the Constitution you would see that it starts with the preamble and if you looked at how that starts you would see, “We the PEOPLE of the United States.”

I lay in bed at night falling asleep next to my partner Tony thinking about how I want to marry him one day, but I realize I can never ask my partner, whom I love, "Will you marry me?" I see billboards, and signs all over Orlando, Fl. advertising for Divorce for $99.00. We as Americans can deny a person the right to marry, because a marriage is between a man and woman, and we must protect the meaning of marriage and not allow same-sex couple to marry, but we advertise for divorce like it doesn't mean anything. If everyone is all up in arms about this then why don't we make divorce illegal. You may laugh, but ask yourself this question: Do I believe in gay marriage?" If no, then why wouldn't you choose yes for making divorce illegal because your argument is over protect marriage, right, Or are you just a hypocritic. We must protect the meaning of marriage. "Till Death Do Us Part!" A line from the "religious ceremony" for two people to be married, but 49% of all marriage end in divorce. Hi, i'm liz. I'm 16 years old and i've been with a girl for the past two years. before that all my realtionships were with guys. We are planning on getting married after we finish high school and move onto college. I think its ridiculous that i'll have to go miles away just to do this. Love is love. I am doing a debate for being against this topic. And what I have learned so far is really ... weird. Right now I am planning my sisters wedding, she is marrying a girl. It is so difficult to plan this, we have to go 11 hours away from our home just so that she can marry the love of her life. I really dont get why people make such a big deal about gay marriage, marriage is about love and passion, if two gay people love each other they should be able to marry it shouldnt be up to the church or anyone else. Why are two straight people that hate each other aloud to get married but two gay people who love each other cant i dont get it.

i believe it is wrong to take away rights that everyone else can have,what happened to equality? And isn't a man and woman marriage viewed that way by the church? With the times our government should be more tolerant by now. Separation of church and state! If it's not what you quite believe it doesn't matter because we are all equal!

I've been in a extremely loving, monogamous, long distance relationship for 6.5yrs. I'm in the USA and he's in Singapore. The distance is horrible. Most people would give up, I'll never let go. Why should I be denied the right to marry and bring lover over like any straight person has the legal right to do.
Our gov must recognize all marriages from other countries so the best route may be to get married in like Canada and force our gov to recognize it. Since a gay marriage in Canada is exactly the same as straight our gov cannot deny one without denying the other.
