Judge Sonia Sotomayor sat on the Second Circuit U.S. Court of Appeals panel in Ricci v. DeStefano, currently being considered by the high court. Just before oral argument last month, Sarah C. On April 22, the Supreme Court will hear oral argument in Ricci v. DeStefano, a case that examines the ability of employers to safeguard equal opportunity in employment testing. This important case marks the first time in decades that the Court will examine a public employer's consideration of race in hiring or promotions.
